The EU AI Act — the primary document regulating the use of artificial intelligence — has come into full effect across the European Union.
The EU has switched on the regulatory power to full capacity, and compliance is now monitored by a dedicated European AI Office equipped with the authority to issue astronomical fines.
It might seem: “Where are EU regulations, and where are my ad campaigns?” But if you drive traffic to EU geos, use AI creative generators, run credit storefronts with smart rotation, or warm up leads via neural network bots, the rules of the game have changed for you too.
Let’s figure out how to avoid getting account bans, prevent payout cuts from advertisers, and adapt your financial funnels.
1. The Main Blow
All content generated or edited by AI (texts, images, deepfakes, videos, audio) is now strictly required to contain clear labeling.
- What this means for creatives: If your landing page or creative was built using Midjourney, ChatGPT, Runway, or HeyGen, it must carry a clear badge or embedded metadata (C2PA).
- Traffic sources on board: Meta, TikTok, and Google have already implemented automated reading of AI metadata. If you upload a generated visual without indicating its origin, moderation will either reject the campaign or the system will automatically attach an “AI Content” label. In the PDL niche, this directly hits CTR if the creative relied on a “live review” format or a personal story.
Tip: Do not try to strip EXIF data, as traffic source detectors learn faster than content uniquifiers. It is better to adopt a hybrid approach: AI creates the concept or base, while a designer manually refines the visual, adds real elements, banking app UIs, and interfaces.
2. PDL Specifics
The financial sector is one of the most strictly regulated areas in the EU. Using AI when working with microloans and MFIs (Microfinance Organizations) falls under several sensitive provisions of the law simultaneously:
AI Storefronts and Smart Rotators
Many webmasters use algorithms for dynamic sorting of MFIs on credit showcases to display the offers with the highest approval chance to the user first.
- What changes: If an algorithm automatically analyzes the user’s device, geo, or input data for stealth “on-the-fly” scoring, such a system risks being classified under the high-risk category.
- How to drive traffic: The process must be transparent. If there is a data collection form on the landing page, add an item to the consent checkbox (Consent Bar / GDPR) stating that offer selection may be partially automated by algorithms.
Ban on Manipulative Push / Retargeting
The law strictly prohibits using AI to exploit human vulnerabilities — including a person’s difficult financial situation or urgent need for money.
- Under strict taboo: AI bots or personalized push notifications that generate aggressive copy such as: “Are you in debt? Our AI is guaranteed to match a 100% approval in 10 seconds without checks before it’s too late!”
- How to adapt: Shift your focus toward informing and convenience: payout speed to card/E-wallet, official MFI status, interest rate transparency, and absence of bureaucracy.
Advertiser Relations (CPL / CPS)
Licensed European MFIs and banks (especially in GEOs like Spain or Poland) are updating their Compliance requirements.
- The reality: The advertiser has no right to accept traffic attracted in violation of the EU AI Act, as the regulator will fine the lender itself.
- Risks: Using black-hat deepfakes featuring famous personalities or fake news about “government payouts” will result in an immediate advertiser ban, blacklisting, and balance voiding for invalid traffic.
3. AI Chatbots and Auto-Funnels
If your funnel includes warming up leads in Telegram/WhatsApp bots or features an “online consultant” on the landing page that generates responses via API:
- Direct legal requirement: The user must understand within the very first second of communication that they are conversing with an algorithm, not a human employee.
- How to maintain conversion rates: You don’t need to write a dry legal disclaimer. Set up the welcome message in a clear, friendly tone:
“Hi! I’m a virtual assistant for the PDL service. I’ll help you select a loan or subscription in 1 minute.”
This fully complies with EU requirements while preserving user trust.
How to Run EU Traffic Without Stress
To avoid losing accounts and payouts in the new reality:
- Update storefront footers: Add a disclaimer: “The service may use automated algorithms to select and sort financial products.”
- Reconfigure bots: Implement an explicit notification “I am a virtual assistant” in the welcome script.
- Abandon deepfakes: Creatives featuring AI videos of presidents/celebrities handing out money can become a ticket to a permanent ban.
- Clarify rules with your manager: Traffic requirements on the ground are changing. Ask your manager if the rules for driving traffic to a specific offer have changed.
